Fairness to Future Persons. Moral Contractualism and the Challenges of Intergenerational Ethics

T. M. Scanlon’s moral contractualism provides a compelling theory of what we owe to each other. However, it faces significant challenges in accounting for our obligations to future generations, especially in light of the non-identity problem. I argue that prominent responses to the non-identity challenge, such as the types-of-persons approach and the non-comparative burden approach, undermine central assumptions of Scanlonian contractualism. As an alternative, I propose and defend a novel fairness approach and argue that we can wrong future persons because we treat them unfairly in an asymmetric power relation, regardless of how their welfare is comparatively affected. This way, Scanlonian contractualism can capture moral obligations to future persons in an important range of non-identity cases.
